TERMS OF SERVICE -THE ARTIST RESERVES THE RIGHT TO REFUSE ANY COMMISSION FOR ANY REASON! -Commissions are completed on a first-come, first-served basis. If a piece must be completed by a deadline, this must be communicated within the initial inquiry. The artist reserves the right to refuse any commissions that cannot be reasonably completed within specified timeframes. -Full payment is required before work will be started. Work will not be started unless full payment has been received. -All listed prices and transactions will be in United States Dollars and not in any other form of currency. -Payments will be made by Paypal invoice. All invoices must be paid in full within 72 hours of being sent, or the commision will be considered abandoned. -The artist reserves the right to stream, record, upload, and share footage and pictures of the creation process of the commissioned work. -Commissioned works will proceed as follows: (1) initial sketch, (2) 72 hour revision period, (3) final product, (4) another 72 hour revision period, and then (5) the work is considered final and complete. Should additional revisions be required beyond this, additional fees will apply. -There are no refunds, except when the artist determines that continued work is impossible for any reason, in which case 50% of the payment will be refunded. Should this occur, the artist will stop all work on the commission, provide a copy of the work to the commissioner as is on the cancellation date, and the artist will retain the rights to use any process of the work completed up to the cancellation date. -Commissions are for personal use only. All commissioned works, including any sketches or work-in-progress (WIP) images, may not be used for any commercial purpose, including but not limited to merchandise, resale, or other commercial purpose. -Should the commissioned work be posted in public spaces, including but not limited to Facebook, Twitter, Twitch, etc., credit must be given to the artist. An example of appropriate credit given would be “Art by Tobi Rose @speakscreature”. -Under no circumstances is the commissioned work to be altered into derivative or transformative works, or otherwise changed so that the original work and the artist is no longer recognizable, excepting where the artist has given express and direct permission -The artist reserves the right to use any commissioned work they do as examples of their portfolio on their personal website, and to share WIP images and sketches to their social media. The artist agrees not to share the finished product to their social media without express permission from the commissioner at the time of performing the work. -By commissioning the artist to perform work, the commissioner acknowledges that they have read, understood, and agreed to all above terms and conditions without exception.
